LIMITED WARRANTY &
LIMITATION OF LIABILITY
|
 |
Each Lumenelle®
product is warranted to be free from defects in material and workmanship
under normal use and service. The warranty period is one year and begins
on the date possession is taken by the Buyer when purchased in person or
on the date of shipment when the product is mailed or otherwise delivered
to the Buyer. |
|
This warranty is
in lieu of all other warranties, express or implied and the implied warranty
of merchantability is limited to one year as above. |
|
Exclusions.
This warranty does not cover: |
|

|
The cost of installation,
removal, or reinstallation, |
|
|
Any product which,
in Lumenelle's opinion, has been misused; altered; damaged from improper
wiring or installation; damaged by accident or vandalism; subjected to
abnormal conditions of operation, handling or storage; or subjected to
neglect, |
|
|
Bulbs, fuses, disposable
batteries unless defective or dead at time of initial possession. |
|
|
Lumenelle's warranty
obligation is limited, at Lumenelle's option, to a refund of the purchase
price, repair at no charge, or the replacement of a defective product when
returned to Lumenelle or to a Lumenelle authorized reseller during the
warranty period. Lumenelle assumes no risk for damage in transit to Lumenelle. |

Warranty support
is available if product is purchased from Lumenelle™ or an authorized reseller.
Lumenelle™ reserves the right to invoice original buyer or end user customer
for importation costs of repair/replacement parts when product purchased
in one country is submitted for repair in another country. |
|
Lumenelle's warranty
obligation is limited, at Lumenelle's option, to a refund of the purchase
price, repair at no charge, or the replacement of a defective product when
returned to Lumenelle™ or to a Lumenelle™ authorized reseller during the
warranty period. |
|
To obtain warranty
service, contact Lumenelle
or the Lumenelle authorized reseller where the purchase was made or send
the product, with a description of the difficulty, postage and insurance
prepaid to Lumenelle. Lumenelle assumes no risk for damage in transit. |
|
Following warranty
repair, the product will be returned to the original buyer or end user
customer. Return transportation is paid by Lumenelle. |
|
If Lumenelle, Inc.
determines that the product is not covered by Warranty due to any of the
exclusions listed above or the warranty period has expired, Lumenelle™
will provide an estimate of repair costs plus any return shipping or delivery
costs. Lumenelle will not commence any repair work prior to obtaining written
authorization from the original buyer or end user customer.

If the original
buyer or end user customer chooses not to have any repair work performed,
original buyer or end user customer is responsible for any return shipping
and/or transportation charges. |
|
If the original
buyer or end user customer chooses to have any repair work performed, the
product will not be returned to the original buyer or end user customer
until all repair and estimated return charges have been paid unless the
customer has a credit account in good standing with Lumenelle™. |
|
|
All shipping and/or
transportation charges for products not covered by warranty are entirely
the responsibility of the original buyer or end user customer. |
|
THIS WARRANTY IS
BUYER'S SOLE AND EXCLUSIVE REMEDY AND IS IN LIEU OF ALL OTHER WARRANTIES,
EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF
MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. LUMENELLE, INC. SHALL
NOT BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES
OR LOSSES, INCLUDING LOSS OF DATA, WHETHER ARISING FROM BREACH OF WARRANTY
OR BASED ON CONTRACT, TORT, RELIANCE OR ANY OTHER THEORY. |

Since some countries
or states do not allow limitation of the term of an implied warranty, or
exclusion or limitation of incidental or consequential damages, the limitations
and exclusions of this warranty may not apply to every buyer. If any provision
of this Warranty is held invalid or unenforceable by a court of competent
jurisdiction, such holding will not affect the validity or enforceability
of any other provision. |
